Conditions d’utilisation

Agreement and consumer protection

These Terms of Service govern use of houseofappliances.shop and purchases made through the store. By accessing the site or submitting an order, the user agrees to these Terms together with the Privacy Policy, Return and Refund Policy, Shipping and Delivery Policy, and product-specific information displayed before checkout.

Mandatory French consumer law prevails over any inconsistent term. Nothing here excludes liability or remedies that cannot lawfully be excluded, including statutory withdrawal rights, the legal guarantee of conformity, rights concerning hidden defects, and data-protection rights.

Eligibility and account responsibility

A purchaser must have legal capacity to contract or act with appropriate authority. Account and checkout information must be accurate, current, and complete. Users are responsible for protecting login credentials and for activity carried out through their account unless caused by our failure or otherwise provided by law.

The site may not be used for fraud, unlawful resale arrangements, interference with security, malicious code, automated extraction that burdens the service, infringement of third-party rights, or any activity prohibited by applicable law.

Product information and suitability

We make reasonable efforts to keep descriptions, images, specifications, availability, and prices accurate. Screen colours and scale may differ from the physical product. Minor non-material differences in packaging may occur. Where an error materially affects an order, we may contact the customer for instructions or cancel and refund the affected item.

Customers must review dimensions, voltage, frequency, plug type, capacity, included accessories, installation needs, compatibility, and safety information before ordering. A product described for domestic use must not be used commercially or outside rated conditions unless expressly stated.

Orders and contract formation

Products placed in a cart are not reserved. Submitting an order is an offer to purchase. The customer can review and correct input errors before final submission. A binding sales contract is formed when we expressly accept the order or dispatch the goods, depending on the checkout communications and applicable law.

We may reject or cancel an order for genuine stock unavailability, payment failure, suspected fraud, delivery impossibility, legal restriction, obvious pricing error, or an incorrectly described product. If payment has been captured, the relevant amount will be returned using the original payment method.

Prices and payments

Consumer prices are intended to be shown in euros inclusive of applicable taxes. Free standard delivery applies to all orders under the Shipping and Delivery Policy. Any optional premium service or other charge will be disclosed before the order is submitted.

Payment providers may perform authorisation and fraud screening. The customer authorises the selected provider to charge the confirmed total. We may delay dispatch until payment is authorised. Customers must not use a payment method without permission.

Delivery and transfer of risk

Delivery terms are set out in the Shipping and Delivery Policy. Risk of loss or damage generally transfers to a consumer when the consumer or a nominated third party other than the carrier takes physical possession, except where the consumer independently commissions a carrier not offered by us and the law provides otherwise.

Ownership may remain with the seller until full payment, without affecting the consumer’s mandatory rights. Customers should not install visibly damaged goods before contacting us.

Installation, use and safety

Follow the manufacturer’s manual, warnings, maintenance schedule, and environmental limits. Fixed electrical, gas, water, ventilation, wall-mounted, or built-in installation must be performed by a competent professional where required. The customer must ensure the premises, electrical circuit, plumbing, ventilation, and support surfaces are suitable.

Improper installation or use may create fire, electric shock, leakage, injury, or property damage. Stop using a product when unsafe symptoms arise. Nothing in this section removes statutory remedies where the product itself is non-conforming or instructions are deficient.

Returns, guarantees and manufacturer services

Returns, withdrawal, refunds, and non-conformity claims are governed by the Return and Refund Policy and mandatory law. A manufacturer’s commercial warranty, if offered, is additional to statutory rights. Manufacturer registration or direct support may assist service but does not remove the seller’s legal responsibility.

Unauthorised alteration, neglected maintenance, accident, misuse, incompatible consumables, unsuitable power supply, or incorrect installation may affect a commercial warranty or factual assessment, but cannot automatically eliminate a statutory claim unrelated to that conduct.

Intellectual property and user content

Site text, layout, graphics, product compilations, and brand elements are protected by applicable intellectual-property laws, subject to third-party rights. Users may view and print reasonable extracts for personal shopping purposes but may not copy, republish, scrape, sell, or exploit content commercially without permission.

If a user submits a review, image, or feedback, the user confirms having the necessary rights and grants us a non-exclusive, worldwide, royalty-free licence to display, moderate, reproduce, and adapt it for store and service purposes. We may remove unlawful, misleading, abusive, private, or irrelevant content.

Third-party services and links

The store relies on Shopify and may link to payment providers, carriers, manufacturers, social networks, or other third parties. Their separate terms and privacy practices may apply. We are not responsible for an independent third-party site merely because it is linked, but we remain responsible for obligations that applicable law places on us.

Liability

We are responsible for foreseeable loss caused by breach of contract or legal duty, subject to applicable law. We do not exclude liability for death or personal injury caused by negligence, fraud, gross fault, defective products where liability is mandatory, breach of essential consumer obligations, or any matter that cannot lawfully be limited.

For business users only, and to the extent permitted by law, indirect loss, lost profit, lost business, and business interruption may be excluded. Consumer remedies are not reduced by this business-user limitation.

Changes, severability, governing law and disputes

We may update these Terms prospectively. The version presented when an order is placed normally governs that order unless a legal change must apply. If one provision is invalid, the remaining provisions continue to the extent possible.

French law applies, without depriving an EU consumer of mandatory protection available in the consumer’s habitual country of residence. Consumers may contact us first, use the designated consumer mediator once properly identified in the Legal Notice, or bring proceedings before a competent court under applicable jurisdiction rules.
